Release Undocumented Youth with Disability Detained During Violent ICE Raid

German Nieto Cruz is a 21 year old, hard-working, youth from New Brunswick, New Jersey who was ripped from his family home during a violent, unjustified, raid. Immigration enforcement has refused to release him based on false accusations.

Now, German’s Deferred Action for Childhood Arrivals (DACA) has been revoked, he is in danger of deportation, and his health is at risk, as he cannot access the surgery he needs to heal a congenital disability while in immigrant detention.

On January 5th, federal agents broke down the door to German’s home and terrorized his family, including the children in the home.

Officers cursed at the family, kicked a family member, and pointed a gun at German’s sister-in-law and the small child she carried on her hip. Officers ordered German’s teenage niece to the ground, sobbing, and pushed her father, German’s brother, to the floor. As this young father tried to console his terrified daughter, an officer slammed his boot on the back of his head.

Without permission from the family and without a search warrant, the officers searched the home and confiscated the family’s belongings, giving no explanation as to who they were or why they were breaking into the home and taking German away.

Immigration authorities have made false accusations of gang membership against German. The government states that German’s arrest is part of a US Marshals Service-Counter Gang Unit operation, but has presented little more than Facebook pictures to support their false accusations.

Several other Latino youth have been detained in NJ, particularly in the New Brunswick area, without a criminal history or criminal charges, based on similar gang-membership accusations. The detainees that have come forward are mostly from the low-income New Brunswick area and are being detained in correctional facilities without any criminal charges.

Advocates and community members have identified this U.S. Marshals Counter Gang Unit operation as misguided at best, racially-profiling and targeting Latino immigrant youth at worst, used to funnel Latino immigrant youth into deportation proceedings.

German Nieto Cruz es un joven trabajador de 21 años, residente de la ciudad de New Brunswick, Nueva Jersey a quien se le separó de su familia durante una redada violenta e injustificada. Las autoridades de inmigración se han negado a dejarlo en libertad a  base de falsas acusaciones.

A German le quitaron su permiso de DACA (Acción Diferida para los Llegados en la Infancia) y ahora está en peligro de ser deportado. Además, su salud está a riesgo porque no tiene acceso a cirugías que necesita para sanar su discapacidad congénita mientras esta en el centro de detención de inmigración.

El 5 de Enero agentes federales rompieron la puerta de la casa de German y aterrorizaron a su familia, incluyendo a menores de edad sin tener prueba de orden judicial y sin tener permiso de entrar al hogar de la familia. 

Los oficiales patearon a un miembro de la familia, y apuntaron una pistola a la cuñada de German y al menor de edad quien ella cargaba en su cadera. Los oficiales le ordenaron a la joven sobrina de German que se tirara al piso mientras lloraba y empujaron a su padre (el hermano de German) al piso.

Sin permiso de la familia y sin orden judicial, los oficiales buscaron el hogar y confiscaron las pertenencias de la familia, sin dar alguna explicación de quienes eran o por que habían entrado a la fuerza para llevarse a German.

Las autoridades de inmigración han acusado injustamente a German de ser miembro de una padilla. El gobierno ha declarado que el arresto de German es parte de la operación de un departamento anti-pandillas del Servicio Mariscal de los Estados Unidos, o el US Marshals Service-Counter Gang Unit.

Otros jóvenes Latino/as han sido detenidos en NJ, particularmente en el área de New Brunswick, sin tener cargos criminales o antecedente criminal, basado en acusaciones similares de participación en pandillas. Los detenidos son primordialmente del área de New Brunswick, de bajos recursos, y están detenidos en una correccional sin tener cargos criminales.   

Miembros de la comunidad han identificado la operación del US Marshals Service-Counter Gang Unit como una operación que basa sus arrestos en discriminación racial, usando su misión anti-pandillaspara encauzar a los jóvenes inmigrantes al proceso de deportación.
