On Thursday January 29, 2015 Palemon was racially profiled ty Georgia police and taken into custody for driving without a license for the 4th time, a felony in under state law. Even though his wife Araceli paid bond immediately, the local police lied and said he had already been transferred to immigration custody so that he would not be released. In reality, he was not transferred to ICE until Monday.
Palemon has a pending U-visa application, and despite the suffering of his wife and children, ICE has refused to allow him to be with his family. In contrast, when he went to immigration court the judge decided to postpone his deportation proceedings until a decision on the U-visa was reached, and requested that the prosecutor work with Palermo and his lawyer to get a bond posted so that he could stay with his family.
Despite the Judge’s request and recommendation, ICE refuses to issue any bond under the excuse that Palemon is a threat to the safety of the community. Palemon does have two driving without a license charges, one from 16 years ago, and a recent one from 2014. These two misdemeanor charges, and the impossible to avoid driving without a license charges, are what ICE is using to separate Palemon from his family.
Palemon needs to be with his family now. There is no reason for ICE to keep him detained, especially with the suffering of his family, and if he is only awaiting for an answer regarding his U-visa application. ICE has the authority to release Palemon, please sign the petition to support his release.

I am writing as a member of the public regarding the case of Mr. Palemon Padron Tirruviartes (A 208-032-693). He is a father of 4 currently detained at the Stewart Detention Center in Georgia, despite recommendation from an immigration judge that he should be released. While he has been detained, his wife had a baby, his oldest daughter as hospitalized for attempted suicide, and two of his children are being treated for severe depression.
Mr. Tirruviartes is a father of 4 children who has lived in the U.S. for the last 19 years. On Thursday January 29, 2015 he was racially profiled ty Georgia police and taken into custody for driving without a license for the 4th time, a felony in under state law. Even though his wife Araceli paid bond immediately, the local police lied and said he had already been transferred to immigration custody so that he would not be released. I understand that Mr.Tirruviartes does have two driving without a license charges, one from 16 years ago, and a recent one from 2014. These two misdemeanor charges, and the impossible to avoid driving without a license charges, do not make him a threat to public safety. In addition, Mr. Tirruviartes has a pending U-visa application, which could provide him relief. This is, and the suffering of his family, is why the immigration judge recommended he be released with a bond.
Mr. Tirruviartes needs to be with his family now. I urge you to take into consideration the family’s extreme hardship, the potential for Mr. Tirruviartes to have relief, and the support from the community, to release him from detention.
