 ICE and DHS Have Failed at Providing Minimum Safety and Dignity for LGBTQ Immigrants in Detention, Immigrant Detention Must End

 

Less than one week after Jennicet Gutierrez courageously interrupted the White House Pride reception to demand that President Obama end the detention and abuse of transgender immigrant women, the administration made public a new memo on the topic.

 

In response to the US Immigration and Customs Enforcement (ICE) guidance, “Further Guidance Regarding the Care of Transgender Detainees,”  the #Not1More campaign and member groups – Familia: Trans Queer Liberation Movement, Transgender Law Center, GetEQUAL, and Southerners On New Ground – issued the following statement:

The day after Jennicet Gutierrez of FAMILIA TQLM interrupted the President at the White House Pride Celebration, Press Secretary Josh Earnest is asked if the President would respond the same way were it to happen again.  After a non-answer, he’s asked if the President is even aware of the issues being raised by Jennicet.

There is no Pride as long as LGBTQ Immigrants are being imprisoned, she says.
WASHINGTON, DC — Just moments ago, Jennicet Gutiérrez  interrupted the President during the White House pride celebration shouting “President Obama, release all LGBTQ immigrants from detention and stop all deportations.” As a transgender woman who is undocumented,  Gutiérrez said she could not celebrate while some 75 transgender detainees were still being exposed to assault and abuse in ICE custody at this very moment.

May 28, 2015 – Santa Ana, CA – Five LGBTQ and Immigrant rights leaders have taken over intersection of Flower and Civic Center, near the detention center in Santa Ana that holds transgender detainees, in a protest risking arrest to demand an immediate end to detention and deportation, starting with releasing undocumented transgender women.



After being questioned directly about the topic, Presidential candidate Hillary Clinton echoed the #Not1More LGBTQ Deportation campaign’s demand to end the detention of transgender immigrants, saying, “I do not think we should put children and vulnerable people into detention facilities because I think they are at risk. Their physical and mental health are at risk.”

Protest organizers today are saying ‘If Clinton can promise it, President Obama can do it now.’

They cite the experience of formerly detained protest participants as well as recent reports exposing the epidemic of violence against undocumented Trans detainees under Immigration and Customs Enforcement’s watch in detention centers around the country as a crisis that needs immediate action. Rogue practices on behalf of ICE include incarcerating Trans women at all male facilities where they are subject to sexual assault and harassment, denying them hormone medication, and through deportation that returns them to situations of likely violence that often spurred their original journey to the US for safety.

Isa Noyola, who is risking arrest, says: “For too long our communities have been experiencing oppression through its immigration system. With each presidential administration advocates rally and push for reform measures and some lose sight of the broader vision for liberation. We are here today to uplift these broader demands of liberation; an end to detention centers and the criminalization of our transgender, gender non-conforming and queer communities. Trans women today are at the frontlines and showing up for our communities because our lives are on the line.”

Marichuy Leal Gamino is 23 years old and grew up in Phoenix, Arizona. She is transgender, and has been detained in immigration custody for over a year. A few weeks ago, she reported experiencing sexual harassment at the Eloy Detention Center, but was told by the guards to “deal with it.” Then just last week she was raped by her cellmate. When she told the guards, they pressured her into signing a statement saying the rape was consensual. 

If ICE can’t guarantee her safety, she should be released immediately. Please sign the petition demanding Marichuy is released.

Even though she is a transgender woman, Marichuy continues to be held in the male-section of the facility and is still in danger. Gay, lesbian, bisexual and transgender detainees are 15 times more likely to be sexually assaulted than other detainees.

Marichuy’s story is one more example showing how the Eloy administration is not capable of guaranteeing a minimum level of safety and dignity for transgendender people. In fact, it is not a safe facility for anyone. Eloy detention center has a long history of conditions that have lead to nearly a dozen deaths in the last decade, including two suicides just last year.

Please sign the petition to makes sure that Marichuy is released immediately.


As part of the National #Not1More Deportation Campaign, LGBTQ Organizations from across the country called on the Congressional Equality Caucus to come out to ensure LGBTQ immigrants benefit from and are included in the broadest relief possible for undocumented people.

As Obama Administration Nears Two Million Deportations, Groups Across Country Say “Not One More,” Urge White House Action

 Transgender Law Center and Southerners On New Ground, alongside a broad coalition of LGBTQ organizations, proudly endorse the #Not1more Deportation campaign and the protests and marches occurring on the April 4th and 5th National Days of Action across the country.

 

Among the two million immigrants deported by the Obama administration—1,100 people deported every day, and 34,000 people caged in immigration detention centers every single night—are countless LGBTQ individuals and their family, friends, and loved ones. Under the current system of detention and deportation, LGBTQ immigrants, especially transgender women of color, often experience horrific treatment within immigration detention centers, including violence, deprivation of necessary medical care, dehumanization and assaults on basic dignity, psychological torture in solitary confinement, and rape. A recent study demonstrated that transgender women survivors made up 20% of substantiated sexual assault claims in immigration detention.[1] Many detained LGBTQ immigrants simply give up and accept deportation rather than continue to fight for the asylum that they qualify for under existing law because their detention conditions are so unbearable. Too many of our deported community members then end up facing the violence and sometimes murder that they had originally come to the United States to flee. The current immigration detention and deportation crisis harms us deeply, and we call on President Obama to act within his powers to end the cruel and senseless tearing apart of LGBTQ people’s communities.
